What Is an Electronic Signature?
Everything you need to know about e-signatures, legality, and getting started.
An electronic signature (e-signature) is a digital indication of intent to agree to a document. It replaces the traditional handwritten signature with a faster, more convenient alternative that is just as legally binding.
Are Electronic Signatures Legal?
Yes. In the United States, e-signatures are legally binding under two key laws:
- ESIGN Act (2000) — Federal law giving e-signatures the same legal weight as handwritten ones
- UETA (1999) — Adopted by 49 states, establishes the legal framework for electronic transactions
Types of Electronic Signatures
- Simple (SES) — Typed name, drawn signature, or click-to-sign
- Advanced (AES) — Linked to signer identity with audit trails
- Qualified (QES) — Uses a qualified certificate, required for some EU transactions
