Are Electronic Signatures Legal?

Yes. In the United States, e-signatures are legally binding under two key laws:

  • ESIGN Act (2000) — Federal law giving e-signatures the same legal weight as handwritten ones
  • UETA (1999) — Adopted by 49 states, establishes the legal framework for electronic transactions

Types of Electronic Signatures

  1. Simple (SES) — Typed name, drawn signature, or click-to-sign
  2. Advanced (AES) — Linked to signer identity with audit trails
  3. Qualified (QES) — Uses a qualified certificate, required for some EU transactions
